Applying for a Child Arrangements Order: C100 guide

A Child Arrangements Order (CAO) sets out who a child lives with and how much time they spend with each parent. You apply using the C100 form. The court’s paramount consideration is always the welfare of the child.

MIAM: the first step

Before applying, you must attend a Mediation Information and Assessment Meeting (MIAM) with an authorised mediator, unless an exemption applies (domestic abuse, urgency, previous court involvement). The mediator signs the C100 to confirm attendance.

Completing the C100

The form requires: details of all children; names and addresses of parties; the specific order you are seeking (where the child lives, when they see each parent); any safeguarding concerns; and MIAM details or exemption.

CAFCASS involvement

CAFCASS (Children and Family Court Advisory and Support Service) will carry out a safeguarding check before the first hearing. They contact police and children’s services to check for any concerns. In most cases they produce a safeguarding letter rather than a full report.

The first hearing (FHDRA)

The First Hearing Dispute Resolution Appointment usually takes place within 4–8 weeks of issue. The judge will hear from both parties and from CAFCASS, and explore whether agreement is possible. Many cases settle at this stage.
